{"id":454,"date":"2022-04-13T16:36:05","date_gmt":"2022-04-13T15:36:05","guid":{"rendered":"http:\/\/bombuy.net\/?p=454"},"modified":"2022-04-20T11:56:07","modified_gmt":"2022-04-20T10:56:07","slug":"cens-enfiteutic","status":"publish","type":"post","link":"https:\/\/bombuy.net\/es\/cens-enfiteutic\/","title":{"rendered":"CENS ENFIT\u00c8UTIC"},"content":{"rendered":"\n<p><strong>QU\u00c8 \u00c9S?<\/strong><\/p>\n\n\n\n<p>A Catalunya, el cens ha estat regulat en diferents normatives, la \u00faltima, els arts. 565-1 i ss del Codi Civil de Catalunya, si b\u00e9 es mantenen normatives transit\u00f2ries per a aquells censos establerts abans de la Llei 6\/1990. En la present entrada, ens centrarem en la normativa establerta en el Llibre V del Codi Civil de Catalunya.<\/p>\n\n\n\n<p>Segons l\u2019art. 565-1 CCCat, el cens \u00e9s una prestaci\u00f3 peri\u00f2dica anual, de car\u00e0cter perpetu (cens emfit\u00e8utic) o temporal (cens vitalici), que es vincula a la propietat d\u2019una finca que en garanteix el seu pagament. Per tant, el propietari de la finca (censatari) queda obligat a pagar al titular d\u2019aquest dret (censalista) la pensi\u00f3 del cens.<\/p>\n\n\n\n<p>Segons l\u2019art. 656-7 CCCat, aquest dret ha de constar necess\u00e0riament inscrit al Registre de la Propietat i, en aquesta inscripci\u00f3, s\u2019hi han de fer constar les dades que estableix el mateix article.<\/p>\n\n\n\n<p><strong>COM ES POT ELIMINAR AQUESTA INSCRIPCI\u00d3<\/strong><\/p>\n\n\n\n<p>1. Regulaci\u00f3 segons el Codi Civil de Catalunya<\/p>\n\n\n\n<p>Les causes legals d\u2019extinci\u00f3 dels cens, regulades a l\u2019art. 656-11 CCCat, &nbsp;s\u00f3n les seg\u00fcents:<\/p>\n\n\n\n<ul><li>Causes generals d&#8217;extinci\u00f3 dels drets reals que, segons l&#8217;art. 532-1 CCCat s\u00f3n: <ul><li>Quan ho estableixi el mateix codi o el t\u00edtol de constituci\u00f3 del dret<\/li><li>P\u00e8rdua del b\u00e9 que en constitueix l&#8217;objecte<\/li><li>Consolidaci\u00f3<\/li><li>Ren\u00fancia del seu titular<\/li><\/ul><\/li><\/ul>\n\n\n\n<ul><li>Redempci\u00f3: es formalitza en escriptura p\u00fablica davant de Notari i consisteix a pagar un preu acordat entre les parts per tal de cancel\u00b7lar l\u2019anotaci\u00f3 al registre.<\/li><li>La falta d\u2019exercici de les pretensions del censalista durant un termini de 10 anys.<\/li><\/ul>\n\n\n\n<p>2. R\u00e8gim transitori<\/p>\n\n\n\n<p>El legislador catal\u00e0 ha seguit una clara tend\u00e8ncia dirigida a facilitar l\u2019extinci\u00f3 dels drets de cens, ja que, avui en dia, es configura com una limitaci\u00f3 del domini.<\/p>\n\n\n\n<p>Aix\u00ed, amb la Llei 6\/1990, de censos, es pretenia afavorir tant l\u2019alliberament de les finques de c\u00e0rregues que les gravin, com la cancel\u00b7laci\u00f3 de les inscripcions registrals.<\/p>\n\n\n\n<p>Aquesta tend\u00e8ncia segueix amb les disposicions transit\u00f2ries del nou Llibre V del Codi civil de Catalunya, referents als terminis de redempci\u00f3, usucapi\u00f3 i prescripci\u00f3 dels cens.<\/p>\n\n\n\n<p><strong>COM ET PODEM AJUDAR?<\/strong><\/p>\n\n\n\n<p><strong>El nostre despatx est\u00e0 especialitzat en la cancel\u00b7laci\u00f3 de censos emfit\u00e8utics, que graven propietats a Terrassa, Rub\u00ed, Sabadell, Barcelona i altres localitats, sense pagar indemnitzacions.
